Franklin County State's Attorney Tom Dinn reports that his office concluded a jury trial on Wednesday, against Joni R. Mocaby, 44, of Logan, which resulted in a conviction on three counts of unlawful delivery of a controlled substance.
The Franklin County jury deliberated for just under 75 minutes before returning a guilty verdict on three of four counts of an indictment returned by the Franklin County grand jury on Jan. 6.
The trial commenced on Nov. 8, with the selection of the seven-woman five-man jury and the presentation of evidence.
Mocaby was convicted of delivering a substance containing morphine to an undercover agent of the Southern Illinois Drug Task Force on Feb. 3, 2003, at Mocaby's residence in Logan.
The remaining counts, which Mocaby was convicted on were for delivery of substances containing diazepam (Valium) and dihydrocodeinone (vicodin) to the same agent, occurring on March 4, 2003, also at Mocaby's residence.
Delivery of the morphine and vicodin are class 2 felonies, carrying a maximum prison term of seven years.
Delivery of the Valium is a class 3 felony, with a five-year maximum prison sentence. A January 18 sentencing date was set by the Honorable Leo T. Desmond.
